You may recall Joe Horn, the Houston-area man who fatally shot two burglars he confronted outside a neighbor's home in November despite a 911 operator's instructions to stay inside his home and wait for police to arrive.
On Monday, a Harris County grand jury decided that Horn should not be charged with a crime, the Houston Chronicle reported. In a recording of the incident, Horn could be heard talking to the 911 operator.
"Well, here it goes, buddy," Horn can be heard saying. "You hear the shotgun clicking and I'm going."
The operator then says, "Don't go outside."
Horn went outside with his 12-gauge shotgun. There he encountered Diego Ortiz, 30, and Hernando Riascos Torres, 38.
Horn can then be heard on the tape warning: "Move and you're dead!" Then two shots are heard, followed by a pause and then a third shot, the Chronicle reported.
Ironically, it all took place in front of a plainclothes detective who had positioned himself outside Horn's house in response to the 911 call.
