Additional autopsy report documents state that investigators believe Jerry Waller initially followed a Fort Worth police officer’s commands to put down his .38-caliber revolver, but then grabbed it up again.
And then Officer R.A. “Alex” fatally shot him. A grand jury on Wednesday decided not to indict Hoeppner for the incident last May.
Waller’s family members did not immediately respond to a request for comment, but their lawyer on Wednesday said an investigation was "being undertaken on behalf of the Waller family.”
So, this case appears to be far from over.
