As law enforcement knows, Texas Transportation Code "citations" do not apply to the common private citizen of Texas utilizing their property upon the PUBLIC roads and highways. And all "citations" must first be handled in an administrative hearing in accordance with the Administrative Procedure Act (Texas Government Code Chapter 2001), not within the judicial court system. Any court that proceeds to act on a "citation" before an administrative hearing has been held, acts without jurisdiction and without the protection of the law. All judges presiding over such cases can and should be held liable for breaking their oaths of office.
